The Plea bargain or what was is known as the way to expedite the criminal justice court process and make the court system efficient. Many people view it as a necessary process and the courts would fail without it while others believe that is was designed to hide the truth and all creates more issues or wrongly imprisoned people. The plea bargain can range from settling for lesser charges if they agree to a certain charge, a more lenient sentencing, or even some of the charges being dropped. But this all happens before some goes to court and is a way to limit the actual number of cases to go fully through the court system. But don’t you think this could have some negative blow back? I surely think is does because for instance think of this scenario where a woman is all of the sudden arrested from her home and taken in custody and all of the sudden the officer says they are being charged with robbery but the person knows for a fact that that can’t be true. But the prosecutor says that if she goes to court that she could face up to five years in jail. But he is willing to have her serve probation if she pleads guilty to the charge but the person didn’t commit the crime. But the prosecutor adds that she could go home right now if she pleads guilty. And also remember that they will stay in jail until the trail which could take months to occur. What would you do? Would you plead guilty to a crime that you know you didn’t commit just so you could go home and not have to stay in jail and wait for your trial?
Believe it or not 95% of people accept the plea bargains presented to them by the prosecutor despite actually committing the crime or not. Which means only 5% of people actually go to trial for their charges or have had cases dismissed while they awaited trial. But the most interesting part to this is if you plead guilty to a charge because of a plea bargain and later the case was dismissed you while still remain as guilty because you took the plea bargain. Isn’t that pretty shitty that they will say guilty despite the case getting dismissed. I believe that they should have the plea reversed and the person be compensated for being put into jail wrongly.
Multiple professors of law at different universities have different views on this idea of the plea bargain but there is a common split between the two. People can take their view of the plea bargain as the please but in reality it has helped the court system but on the other hand many have plead guilty to avoid court despite them not ever committing the crime. I guess that’s the big dilemma of the plea bargain system. We need it but it is flawed and maybe the flaws are no acceptable for people when they think of the courts as a source of justice.
